PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT.

By registering for, participating in, attending, observing, volunteering at, or otherwise being present at any Augusta Premier Kickball activity, event, league, tournament, practice, game, social gathering, fundraiser, sponsor event, championship event, draft night, mixer, clinic, meeting, or related activity (collectively, the "Activities"), I acknowledge and agree as follows:

1. ASSUMPTION OF RISK

I understand and acknowledge that participation in recreational sports and related activities involves inherent risks that cannot be eliminated regardless of the care taken to avoid injuries.

I knowingly and voluntarily assume all risks associated with participation in the Activities, whether known or unknown, foreseeable or unforeseeable, including but not limited to:

* Slips, trips, and falls
* Collisions with players, spectators, officials, volunteers, equipment, fences, vehicles, structures, or field obstacles
* Being struck by a kicked, thrown, or batted ball
* Muscle strains, sprains, tears, fractures, dislocations, concussions, traumatic brain injuries, and other physical injuries
* Illness, infection, communicable diseases, and medical complications
* Weather-related hazards including heat, cold, rain, lightning, and severe weather
* Defective or improperly maintained equipment
* Conditions of fields, facilities, parking lots, walkways, or surrounding property
* Negligent acts or omissions of other participants
* Transportation-related incidents occurring before, during, or after Activities
* Emotional distress, economic loss, permanent disability, paralysis, or death

I fully accept and assume all such risks and responsibility for any losses, damages, injuries, illnesses, costs, or expenses that may result from my participation in the Activities.

2. RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, attorney's fees, judgments, or claims of any nature whatsoever arising out of or relating to my participation in the Activities.

This release applies to claims involving:

* Personal injury
* Bodily injury
* Illness
* Disease
* Disability
* Emotional distress
* Property damage
* Economic loss
* Wrongful death
* Death

including claims arising from the ordinary negligence of the Released Parties.

3. DEFINITION OF RELEASED PARTIES

For purposes of this Agreement, "Released Parties" shall include:

Augusta Premier Kickball ("APK"), its owner(s), members, managers, officers, directors, league administrators, captains, employees, contractors, volunteers, representatives, agents, sponsors, advertisers, vendors, affiliates, successors, and assigns;

and

Any municipality, county, city, school district, military installation, park authority, athletic complex, property owner, facility operator, facility staff member, maintenance personnel, governing authority, sponsor location, restaurant, bar, event venue, or other location utilized in connection with APK Activities;

and

Each of their respective officers, directors, employees, volunteers, contractors, agents, representatives, affiliates, successors, and assigns.

4. MEDICAL INSURANCE AND EXPENSES

I certify that I have adequate health insurance coverage or otherwise accept full financial responsibility for any and all medical expenses arising from participation in the Activities.

I understand that Augusta Premier Kickball does not provide medical, accident, disability, hospitalization, or health insurance coverage for participants.

I agree that I am solely responsible for any costs associated with:

* Emergency treatment
* Ambulance transportation
* Hospitalization
* Surgery
* Rehabilitation
* Physical therapy
* Prescription medications
* Follow-up care

I agree not to seek reimbursement, contribution, compensation, or damages from the Released Parties for any medical expenses or related losses.

5. EMERGENCY MEDICAL AUTHORIZATION

In the event of an emergency, accident, illness, or injury, I authorize Augusta Premier Kickball and its representatives to obtain emergency medical treatment on my behalf if deemed reasonably necessary.

I understand that:

* APK has no duty to provide medical care.
* APK assumes no responsibility for medical decisions made on my behalf.
* All medical costs remain my sole responsibility.

6. INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, lawsuits, liabilities, damages, losses, costs, expenses, settlements, judgments, and attorney's fees arising out of or related to:

* My participation in the Activities;
* My conduct during or related to the Activities;
* Any injury, damage, or loss caused by me;
* Any claim brought by another participant, spectator, family member, or third party arising from my actions or omissions.

7. FITNESS TO PARTICIPATE

I certify that:

* I am physically capable of participating in the Activities.
* I do not suffer from any medical condition that would make participation unsafe.
* I have consulted with a physician if I have concerns regarding my fitness to participate.

I understand that if I experience any injury, illness, or unsafe condition, I should immediately discontinue participation and seek appropriate medical attention.

8. CODE OF CONDUCT

I agree to abide by all league rules, policies, procedures, and instructions established by Augusta Premier Kickball.

I understand that:

* Fighting, threats, harassment, discrimination, intimidation, or dangerous conduct will not be tolerated.
* Unsportsmanlike behavior may result in warnings, suspension, or removal from the league.
* APK reserves the right to remove any participant whose conduct is deemed detrimental to the league.
* Removal, suspension, or expulsion from the league does not entitle me to a refund.

9. SOCIAL EVENTS

I understand that Augusta Premier Kickball may organize, sponsor, promote, recommend, facilitate, or advertise social gatherings, draft nights, free agent mixers, sponsor events, championship celebrations, restaurant outings, happy hours, fundraisers, charitable events, and other gatherings before, during, or after league activities.

I acknowledge that participation in such events is voluntary and may involve additional risks including:

* Transportation-related incidents
* Alcohol-related incidents
* Personal injury
* Illness
* Property loss
* Criminal acts of third parties

I voluntarily assume all risks associated with attending such events and release the Released Parties from any claims arising from or related to my attendance or participation.

10. COMMUNICABLE DISEASES

I acknowledge that participation in Activities may expose me to communicable diseases, viruses, bacteria, infections, or other health conditions, including but not limited to COVID-19, influenza, RSV, and similar illnesses.

I voluntarily assume all risks associated with exposure to such conditions and release the Released Parties from any related claims.

11. PERSONAL PROPERTY

I understand that the Released Parties are not responsible for the loss, theft, or damage of any personal property.

I assume all risk regarding any personal belongings brought to any Activity, including vehicles and their contents.

12. SPECTATOR ACKNOWLEDGMENT

I acknowledge that this Agreement applies whether I am:

* Actively participating;
* Serving as a captain, volunteer, or official;
* Attending as a spectator;
* Present at a facility or event location.

I understand that risks may exist even when I am not actively participating in a game.

13. PHOTO, VIDEO, AND MEDIA RELEASE

I grant Augusta Premier Kickball and its designees the unrestricted right to photograph, videotape, record, publish, reproduce, edit, distribute, display, and otherwise use my name, image, likeness, voice, appearance, and participation for any lawful purpose.

Such uses may include:

* Social media
* Websites
* Advertising
* Marketing
* Promotional materials
* Sponsorship materials
* Print publications
* Broadcast media

I understand that I will receive no compensation, royalties, or other consideration for such use.

I waive any right to inspect or approve the finished product or use thereof.

14. SEVERABILITY

If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

15. GOVERNING LAW AND VENUE

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia.

Any dispute arising from or relating to this Agreement or participation in the Activities shall be brought exclusively in a court of competent jurisdiction located in Richmond County, Georgia, unless otherwise required by law.

16. ELECTRONIC ACCEPTANCE

I agree that my electronic signature, electronic acceptance, checking of an acknowledgment box, online registration, payment submission, or any other electronic manifestation of assent shall constitute my legally binding signature and shall have the same force and effect as an original handwritten signature.

17. BINDING EFFECT

This Agreement shall be binding upon me and my spouse, heirs, beneficiaries, next of kin, executors, administrators, personal representatives, successors, and assigns.

ACKNOWLEDGMENT AND AGREEMENT

BY ACCEPTING THIS WAIVER, I ACKNOWLEDGE THAT:

* I HAVE READ THIS ENTIRE AGREEMENT.
* I FULLY UNDERSTAND ITS TERMS.
* I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
* I UNDERSTAND THAT THIS IS A RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT.
* I AM ACCEPTING THIS AGREEMENT FREELY, VOLUNTARILY, AND WITHOUT COERCION.
* I AM AT LEAST EIGHTEEN (18) YEARS OF AGE.
* I INTEND FOR THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW.
